Terms of Service

1. Eligibility

You must be at least 18 years old to use SnapChartGPT. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into a binding agreement.

2. Description of Service

SnapChartGPT provides AI-powered analysis of financial charts (including stocks and cryptocurrency) that users upload or capture via camera. The Service may generate commentary, pattern identification, and informational output based on chart images, and includes a trade journal feature for logging trades. Features, availability, and subscription tiers may change at any time.

3. NOT FINANCIAL ADVICE — IMPORTANT DISCLAIMER

THIS SECTION IS CRITICAL. READ CAREFULLY.

SnapChartGPT is an informational and educational tool only. It is NOT:

• A registered investment adviser, broker-dealer, or financial planner
• A provider of personalized investment, trading, tax, or legal advice
• A guarantee of any trading outcome, profit, or accuracy

All output generated by SnapChartGPT — including AI-generated chart analysis, pattern recognition, buy/sell signals, indicators, or commentary — is provided for informational and educational purposes only and should not be construed as a recommendation to buy, sell, or hold any security, cryptocurrency, or other financial instrument.

AI-generated output can be incomplete, outdated, misleading, or simply wrong. Trading charts, technical indicators, and mathematical pattern-recognition models are inherently imperfect and cannot predict future market movements. You understand and agree that SnapChartGPT depends on automated analysis and unproven or probabilistic models that cannot be relied upon as accurate investment guidance.

Trading and investing involve substantial risk of loss, including the potential loss of your entire investment. Past performance — whether real, simulated, or backtested — is not indicative of future results. You are solely responsible for your own trading and investment decisions.

Before making any trade or investment decision, you should:

• Conduct your own independent research and due diligence using multiple sources
• Consult a licensed, registered financial professional
• Never risk money you cannot afford to lose

You agree that SnapChartGPT is not responsible or liable for any trading losses, missed opportunities, or financial harm resulting from your use of, or reliance on, the Service.

3a. Business Structure

SnapChartGPT is currently operated as an independent, unincorporated business (no corporation or LLC has been formed). This means there is no legal entity separate from the individual operator, even though this document does not name that individual.

4. Accounts

You may create an account using Google Sign-In or email/password. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at snapchartgptsupport@gmail.com if you suspect unauthorized access.

5. Subscriptions, Billing & Cancellation

SnapChartGPT offers paid subscription tiers (e.g., Basic, Plus, Premium), each with different features and usage limits, billed on a recurring basis (currently monthly) through our payment processor, Whop.

• By subscribing, you authorize recurring charges to your chosen payment method until you cancel.
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period, and you will retain access until then.
• Refunds: All subscription payments are non-refundable, except where required by applicable law. You may cancel your subscription at any time to stop future billing; cancellation prevents further charges but does not entitle you to a refund for the current or any prior billing period.
• We reserve the right to change subscription pricing with advance notice. Continued use after a price change constitutes acceptance.
• Payment processing is handled by Whop, a third-party provider. We do not store your full payment card details on our own servers.

6. User Content (Uploaded & Captured Charts)

When you upload or photograph a chart using the Service, you grant SnapChartGPT a limited, non-exclusive, royalty-free license to process, store, and analyze that image solely to provide the Service to you (including via third-party AI processing providers). You retain ownership of any content you submit.

You agree not to upload content that:

• Infringes another party's intellectual property rights
• Contains malicious code
• Is unlawful, abusive, or violates any third party's rights

7. Trade Journal

The trade journal feature allows you to log your own trades for personal record-keeping. This data is for your own use; SnapChartGPT does not verify, audit, or guarantee the accuracy of journal entries, and the journal is not a substitute for official brokerage records or tax documentation.

8. Acceptable Use

You agree not to:

• Reverse-engineer, scrape, or attempt to extract the Service's underlying models or source code
• Use the Service to build a competing product
• Circumvent usage limits, subscription tiers, or access controls
• Use automated means (bots, scripts) to access the Service beyond normal use
• Resell, sublicense, or redistribute the Service's output as your own product without permission
• Use the Service for any unlawful purpose, including market manipulation or fraud

9. Intellectual Property

SnapChartGPT, its logo, design, software, and underlying technology are the exclusive property of SnapChartGPT's operator. Nothing in these Terms grants you any right to our trademarks, branding, or proprietary technology beyond your limited right to use the Service as intended.

10. Third-Party Services

The Service relies on third-party providers, including but not limited to Whop (payments), Supabase (data storage and authentication), and Google (sign-in). We are not responsible for outages, errors, or data handling practices of these third parties beyond our agreements with them. Market and price data displayed in the Service may be sourced from third-party data providers and may be delayed, incomplete, or contain errors.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY AI-GENERATED OUTPUT, MARKET DATA, OR ANALYSIS.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SNAPCHARTGPT AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR TRADING LOSSES, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless SnapChartGPT and its owners, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to the Service or other users. You may stop using the Service and cancel your subscription at any time.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the Service or email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.
